1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and DealCalm ("DealCalm", "we", "us"). By creating an account, downloading our mobile app, or accessing DealCalm.com, you agree to be bound by these Terms and our Privacy Policy.
If you access DealCalm via iOS, your use is also subject to the standard Apple Licensed Application End User License Agreement (EULA), available at Apple Standard EULA .
2. AI Negotiation Coaching & Educational Disclaimer
DealCalm is an artificial intelligence-driven training and simulation platform designed to help users practice high-stakes conversational and behavioral negotiation principles (such as strategic empathy and calibrated inquiry).
Important Disclaimers:
- Not Legal or Financial Advice: DealCalm is not a law firm, financial advisory, human resources consultant, or certified employment agency. AI-generated roleplay responses, tactical suggestions, scorecards, and transcripts do not constitute legal, financial, or formal contractual counsel.
- No Guarantees: While practice and preparation can improve communication, DealCalm does not guarantee specific monetary gains, salary raises, business deal closures, or litigation outcomes in real-world negotiations.
- User Responsibility: You remain solely responsible for your real-world business decisions, agreements, verbal statements, and legally binding contracts.
3. In-App Purchases, Billing & Auto-Renewable Subscriptions
DealCalm offers free tier access alongside premium auto-renewable subscription plans ("DealCalm Pro").
Subscription Terms & Billing Details:
Payment: Payment will be charged to your Apple ID Account (for iOS purchases) or Google Play Account at confirmation of purchase.
Automatic Renewal: Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing cycle.
Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
Managing & Cancelling Subscriptions: You can manage your subscriptions and turn off auto-renewal at any time by going to your Account Settings in the App Store or Google Play Store after purchase.
Free Trials: If a free trial period is offered, any unused portion of the trial period will be forfeited when you purchase a subscription to that publication, where applicable.
Refunds: All refund requests for purchases made via the Apple App Store are subject to Apple's standard refund policies and must be initiated through reportaproblem.apple.com.
4. Fair Use Policy (Unlimited Pro Plan) & Single-User License
DealCalm Pro includes unlimited live voice negotiation drills and practice minutes. This offering is designed to empower individual professionals to practice freely and build conversational mastery without artificial minute metering.
To preserve low-latency audio infrastructure and ensure equal service quality for all users, the following fair use rules apply:
- Individual Single-User License: DealCalm Pro accounts are strictly licensed for individual use by a single human subscriber. Account sharing, credential pooling, group distribution, or sharing logins across multiple people or teams is strictly prohibited. For multi-user or team usage, an Enterprise / Team subscription is required.
- Single Active Session Limit: To enforce single-user licensing and maintain real-time voice fidelity, an account may run only one (1) active training or coaching session at any given time. Starting a session while another is active will prompt you to conclude or take over the active session. Concurrent streaming across multiple tabs, windows, or devices is not permitted.
- Human Interactive Use Only: All voice practice drills must involve interactive human speech. Automated streaming, synthetic audio piping, bot relays, benchmarking scripts, stress-testing harnesses, or continuous unattended audio loops are strictly prohibited.
- Continuous Stream Stability: Individual practice drills support extended continuous voice negotiations without arbitrary time interruptions, permitting comprehensive 60+ minute roleplays.
- Fair Use Enforcement: If abnormal, non-human, or abusive account-sharing patterns are detected, DealCalm reserves the right to rate-limit or suspend access after reasonable notice, in accordance with these Terms.
5. User Accounts & Security
To use DealCalm, you must create an account. You agree to:
- Provide accurate and complete registration information.
- Maintain the confidentiality of your login credentials.
- Promptly notify us at admin@dealcalm.com if you suspect unauthorized access.
6. Acceptable Use & Prohibited Activities
You agree not to engage in any of the following prohibited behaviors:
- Reverse engineering, decompiling, or attempting to extract the source code or proprietary AI prompt architectures of DealCalm.
- Using automated scrapers, spiders, or bots to harvest transcripts, UI components, or pricing algorithms.
- Transmitting unlawful, harassing, defamatory, or abusive content through the microphone audio stream.
- Attempting to bypass subscription paywalls, rate limits, or Firebase Firestore security rules.
7. Intellectual Property & Ownership
Your Data: You retain full ownership of your proprietary deal numbers, scenario notes, and personal negotiation recordings. We claim no ownership over your practice content.
DealCalm Property: The DealCalm platform, brand identity, visual design tokens, algorithms, voice prompts, and software codebase are protected by copyright, trademark, and intellectual property laws and remain the exclusive property of DealCalm.
8. Limitation of Liability
To the maximum extent permitted by applicable law, DealCalm and its officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or damages resulting from real-world business negotiations, contract signings, or employment disputes.
In no event shall DealCalm's total aggregate liability exceed the total amount paid by you to DealCalm in the twelve (12) months preceding the claim.
9. Termination & Account Deletion
You may terminate your account at any time via Settings or by emailing admin@dealcalm.com. We reserve the right to suspend or terminate accounts that violate these Terms.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DealCalm operates, without regard to its conflict of law principles.
